TERMS OF SERVICE
Effective Date: Launch Date
Last Updated: Launch Date
These Terms of Service (“Terms”) govern your access to and use of the Amaryis website and related services at amaryis.com (collectively, the “Site”).
The Site is operated by ANDEM COMMERCE LLC, a California limited liability company doing business as Amaryis (“Amaryis,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms, do not use the Site.
1. Eligibility
You must be at least 18 years old to use Amaryis.
By using the Site, you represent that:
- You are at least 18 years old;
- You have the legal capacity to enter into these Terms; and
- The information you provide is accurate and truthful to the best of your knowledge.
2. About Amaryis
Amaryis operates a marketplace and lead-generation service intended to help homeowners and others seeking home-improvement, accessibility, safety, remodeling, and aging-in-place services identify potentially relevant contractors.
Amaryis may facilitate introductions and communications between users and independent contractors.
Amaryis is not itself a contractor, construction company, architect, engineer, home inspector, healthcare provider, or other professional service provider unless expressly stated otherwise.
3. Project Requests
You may submit information describing a project or service you are considering.
Project information may include:
- Project location
- Requested services
- Project scope
- Timeline
- Budget range
- Property type
- Project goals
- Accessibility or safety concerns
- Other information you choose to provide
You agree to provide information that is accurate and not intentionally misleading.
You should not submit confidential information, financial account credentials, passwords, medical records, Social Security numbers, or other sensitive information that is not reasonably necessary to describe your project.
4. Contractor Matching and Lead Distribution
After receiving a project request, Amaryis may use information you provide to identify contractors whose services and geographic coverage may be relevant to your request.
Amaryis may provide limited project information to matched contractors so they can evaluate an opportunity.
Amaryis may offer an individual lead opportunity to up to four contractors, subject to availability and our operating rules.
A contractor may accept or decline an offer.
When a contractor accepts an applicable lead opportunity, Amaryis may release your contact information to that contractor so the contractor can contact you regarding your requested project.
By submitting a request, you understand and agree that:
- Amaryis may evaluate and match your request;
- Relevant project information may be provided to matched contractors;
- Your contact information may be released to a contractor after that contractor accepts the applicable opportunity; and
- You may receive communications from Amaryis and/or matched contractors concerning your requested project.
5. No Guarantee of Contractor Availability or Results
Amaryis does not guarantee that:
- A contractor will accept your request;
- A contractor will contact you;
- A contractor will be available;
- A contractor will be located within a particular distance;
- You will receive any particular number of contractor responses;
- A contractor will provide a particular price;
- A project will be completed;
- A contractor will meet your expectations; or
- Any particular result will occur.
Matching is intended to help facilitate potential connections and does not constitute an endorsement, certification, warranty, or guarantee of any contractor.
6. Independent Contractors
Contractors using Amaryis are independent businesses.
Amaryis does not employ contractors merely because they use the Site or receive leads through Amaryis.
Nothing in these Terms creates an employment, agency, joint venture, franchise, fiduciary, partnership, or other representative relationship between Amaryis and any contractor unless separately agreed in writing.
Contractors are responsible for their own:
- Licenses
- Permits
- Insurance
- Employees
- Subcontractors
- Pricing
- Estimates
- Contracts
- Workmanship
- Project schedules
- Compliance with applicable laws
- Communications with homeowners
You should independently evaluate any contractor before entering into a contract or allowing work to begin.
7. Contractor Estimates and Agreements
Any estimate, proposal, quote, contract, scope of work, warranty, guarantee, schedule, or other commitment provided by a contractor is provided by that contractor and not by Amaryis.
Amaryis does not determine contractor pricing.
Any agreement for construction, remodeling, installation, repair, accessibility work, or other services is between you and the contractor unless Amaryis expressly states otherwise in writing.
You are responsible for reviewing all contractor agreements before signing them.
8. Home Improvement and Safety Information
Information on Amaryis may be intended for general informational purposes.
It is not a substitute for professional advice from a qualified contractor, architect, engineer, building professional, healthcare professional, or other appropriate professional.
You should obtain appropriate professional evaluation before undertaking projects involving structural changes, electrical work, plumbing, accessibility equipment, elevators, lifts, ramps, stairs, or other work that may require specialized expertise, permits, inspections, or professional judgment.
9. Communications
By submitting a project request, you understand that Amaryis may contact you regarding your request.
You also understand that submission of a request may result in contact from matched contractors regarding the project.
Communications may occur by telephone, text message, email, or other communication methods associated with the contact information you provide, subject to applicable law and any applicable consent requirements.
You may withdraw consent for certain communications by contacting us at:
or by using an applicable unsubscribe mechanism.
Withdrawal of consent does not necessarily prevent communications that are necessary to fulfill a transaction, provide a requested service, maintain security, or comply with applicable law.

19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AMARYIS AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR SERVICES.
AMARYIS IS NOT RESPONSIBLE FOR THE ACTS, OMISSIONS, WORKMANSHIP, REPRESENTATIONS, PRICING, CONTRACTS, LICENSES, INSURANCE, OR PERFORMANCE OF INDEPENDENT CONTRACTORS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF AMARYIS ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID DIRECTLY TO AMARYIS FOR THE APPLICABLE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100).
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

These Terms are intended to be governed by the laws of the State of California, except to the extent applicable federal law or non-waivable consumer-protection laws provide otherwise.
23. Termination
